Terms of Service

These Terms of Service ("Terms") govern access to and use of trendingsongs.lol (the "Service"), including the public leaderboard, song pages, checkout, and related features. By using the Service, listing a song, boosting a song, or completing a payment, you agree to these Terms and to our Rules. If you do not agree, do not use the Service and do not pay for a ranking.

Operator and contact

The Service is operated by trendingsongs.lol, based in Canada ("we", "us", "our"), from https://trendingsongs.lol. Legal, listing, and takedown notices: contact@trendingsongs.lol. These Terms work together with the public Rules. If the Rules and these Terms conflict, these Terms control.

What the Service is

trendingsongs.lol is a paid public ranking of songs. You may pay to list a song — a link to a track on Spotify, Apple Music, SoundCloud, or YouTube — and to occupy a rank based on the total amount paid toward that song, according to the Rules. Anyone may also pay to "boost" any song already on the board. Listings and boosts are paid promotions, not editorial reviews, endorsements, official chart placements, or independent rankings. A payment buys a spot on the board at the rank that a song's total can take at the time it is fulfilled. It does not buy plays, streams, listeners, followers, customers, revenue, exclusive placement, a fixed duration at a specific rank, placement on any official music chart, or any particular result. Someone else can pay more and outrank you. Today's board only counts money spent in a rolling 24-hour window. We may change, pause, or discontinue features, categories, and ranking formulas.

Eligibility

You must be at least 18 years old and able to form a binding contract. If you use the Service for a company, label, or organization, you represent that you have authority to bind it, and "you" includes it. You may not use the Service if you are prohibited from receiving services under the laws of Canada, the United States, or another applicable jurisdiction, including trade sanctions.

Payments, Stripe, and taxes

Checkout is processed by Stripe. We do not collect or store full payment-card numbers; Stripe handles card data, and Stripe's terms and privacy notice also apply to the payment itself. Amounts are priced in US dollars. Applicable taxes may be added at checkout. Minimums, the amount to take #1, per-song totals, and boost pricing are described in the Rules and shown before you pay. Completing checkout is an offer to buy ranking placement on those terms. Rank is assigned when payment is confirmed and the bid is written to the board, at whatever position the song's total then supports.

No refunds

All payments are final and non-refundable. Ranking placement is a digital service that begins as soon as payment is confirmed: the song is listed or its rank is raised, and the paid amount is counted on the public board. Being outranked later, a drop on Today's board after 24 hours, fewer plays than you hoped for, downtime, or a later removal for breach of these Terms does not create a refund. By completing checkout you request that we start this digital service immediately and acknowledge that you lose any statutory right of withdrawal or cooling-off period to the extent the law allows that waiver. Where a mandatory consumer right cannot be waived, we honor it. Chargebacks or payment disputes without a legally required basis are a breach of these Terms; we may remove the listing and refuse future use of the Service.

Songs only; who may list

A listing must be a link to a single, publicly available song on Spotify, Apple Music, SoundCloud, or YouTube. Playlists, albums without a specific song, chat or invite links, link shorteners that hide the real destination, and non-music links are not permitted. Anyone may list or boost a song — an artist promoting their own work, or a fan supporting an artist. You are responsible for the link you submit. You may not list a song to impersonate an artist, label, or brand, to harass, or to imply an endorsement that does not exist. If you list your own music, you represent that you have the right to promote it here.

Your warranties

By submitting a link, a name, or a payment, you represent and warrant that: you have the right to link to that song and to send visitors to it; the listing complies with all applicable laws, including advertising, consumer, privacy, and intellectual-property rules; you are not impersonating another person, artist, label, or brand; the destination is a genuine public music track and not malware, phishing, or a link whose purpose is to deceive visitors; and the information you submit is accurate and will be kept accurate.

Prohibited listings and use

In addition to the Rules, you may not list or use the Service for: sexual, pornographic, or adult content; chat, invite, or messaging-group links, or link shorteners used to hide the real destination; content that is illegal, fraudulent, defamatory, harassing, hateful, violent, or that exploits children; infringement of copyright, trademark, or other rights, including unauthorized uploads presented as your own; or interfering with the Service — scraping beyond ordinary browsing, manipulating play or bid counts, bypassing rate limits, automated bids without our written permission, or reverse engineering except as allowed by mandatory law.

Our right to remove listings

We may refuse, delay, edit, recategorize, hide, or permanently remove any listing, rank, or related page, with or without notice, including where we believe these Terms, the Rules, or the law may have been broken; where a rights holder or platform complains; or where we think the listing creates legal, security, or reputational risk. Removal does not entitle you to a refund.

Fair use and third-party content

To run the board we fetch and display publicly available information about listed songs: titles, artist names, cover art, and platform player embeds from Spotify, Apple Music, SoundCloud, and YouTube. We use that material only to identify the listed song, to show visitors what a paid ranking points to, and to operate, moderate, and improve the Service. This is intended as nominative fair use — we use only what is needed to identify the song, we do not use it as our own brand, and we do not suggest sponsorship or endorsement by any platform, artist, or label unless the lister is that rights holder. trendingsongs.lol is not affiliated with, endorsed by, or sponsored by Spotify, Apple Music, SoundCloud, YouTube, or any artist or label. Those names and marks remain their owners' property. trendingsongs.lol, our wordmark, and the look of the Service are ours; you may not copy the Service or scrape the board for a competing ranking product.

License you grant us

You grant us a worldwide, non-exclusive, royalty-free license to host, cache, reproduce, adapt (for sizing, formatting, and ranking display), and publicly display the listing and the public metadata we fetch, for as long as needed to operate, promote, and keep an archive of the Service. To take a listing down, email contact@trendingsongs.lol. Takedown does not undo a completed payment.

Copyright and rights notices

If you believe a listing infringes your copyright, trademark, or other rights, or that a listed link is unlawful, email contact@trendingsongs.lol with: (1) your name and contact details; (2) the listing on trendingsongs.lol; (3) the destination link; (4) a description of the problem; and (5) a statement that the notice is accurate and that you are the rights holder or authorized to act. We may remove or restrict the listing while we review, and may share the notice with the lister. Repeat or abusive notices may be ignored.

No endorsement, no results claims

Appearance on the board is not our opinion of a song. We do not verify that listed songs, artists, or claims are accurate. Play counts and visitor numbers describe what our systems recorded; they are not a promise you will get the same outcome. Your results depend on your rank, the song, timing, and factors we do not control. Links to songs leave trendingsongs.lol; those platforms have their own terms and practices, and we are not responsible for them.

Availability and changes

We provide the Service as-is. It may be unavailable, slow, or incorrect. We may change ranking rules, minimums, categories, or these Terms. If a change is material, we will update the date at the top of this page. Continued use after a change means you accept the new Terms. For a payment already completed, the Terms in effect at checkout still apply, except where a change is required by law or needed to address a security or legal risk.

Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that listings, names, images, ranks, or play counts are accurate or complete.

Limitation of liability

We do not limit liability that applicable law says we cannot limit. Subject to that: we are not liable for lost profits, lost data, lost goodwill, or other indirect, incidental, special, or consequential damages; and our total liability for a claim relating to a payment is limited to the amount you paid us for the listing that the claim concerns in the three months before the claim.

Indemnity

You will defend, indemnify, and hold harmless the operator and people working on the Service from claims, damages, losses, and reasonable legal fees arising out of your listing, the song or destination you submit, your payment or chargeback, your breach of these Terms, or your infringement of someone else's rights.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, excluding conflict-of-law rules. If you are a consumer with a mandatory local law that cannot be displaced, that law still protects you. Courts located in Ontario, Canada have jurisdiction to the extent permitted.

General

If a part of these Terms is unenforceable, the rest remains in effect, and the invalid part is replaced by the closest valid term. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service. These Terms, the Rules, and the checkout details you confirm form the entire agreement for the Service. Payments and hosting involve third parties, including Stripe and our hosting provider; their outages or decisions are outside our control.
